EcoCommunity – Terms of Service

Welcome to EcoCommunity. By accessing or using our marketplace (“Platform”), you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, you may not use the Platform.
EcoCommunity (“we,” “our,” “us”) is a community-based marketplace designed to support creators, uplift communities, and restore nature.
- Acceptance of Terms
By creating an account or using EcoCommunity, you confirm that you:
Are at least 18 years old
Are legally able to enter a binding agreement
Have read, understood, and agreed to these Terms
If you access the Platform on behalf of an organization, you represent that you have authority to bind that entity.
- Use of the Platform
You agree to use EcoCommunity only for lawful purposes. You may NOT:
Post, upload, or sell illegal or harmful items
Sell counterfeit, stolen, or infringing goods
Harass, defame, or abuse users
Upload malware or attempt to damage the Platform
Attempt to bypass security measures
Misuse the Platform in any way
We may suspend or terminate accounts that violate these Terms.
- Account Creation
You must provide accurate information when creating an account. You are responsible for maintaining your password and keeping your account secure.
Any activity occurring under your account is your responsibility.
- Seller Responsibilities
Sellers are responsible for:
The accuracy of product listings
Descriptions, images, and pricing
Fulfilling orders promptly
Shipping, packaging, and handling
Complying with local, state, and federal laws
Managing taxes and financial reporting
Sellers retain ownership of their content but grant EcoCommunity permission to display, promote, and distribute it on the Platform.
- Buyer Responsibilities
Buyers agree to:
Provide accurate shipping information
Purchase items in good faith
Not request fraudulent refunds or chargebacks
Respect the work and intellectual property of creators
Seed packets included with purchases must be planted only in legal, appropriate areas.
- Payments, Commissions & Fees
EcoCommunity uses a third-party payment processor. By using the Platform, you agree to their terms and fees.
Commission Split (Per Sale)
90% to the creator (seller)
5% to EcoCommunity (platform earnings)
5% to the Community Distribution Fund (CDF)
CDF will go up to 10% as revenue grows
This applies to product sales and commission-based work.
Marketplace Revenue Allocation
Of all platform revenue accumulated:
10% is allocated to the CDF
CDF will go up to 15% as revenue grows
5% is allocated to EcoCommunity
These percentages help fund community support, operations, and future initiatives.
- Community Distribution Fund (CDF)
The Community Distribution Fund (“CDF”) is a shared pool designed to support creators and community initiatives.
The CDF receives:
10% of marketplace revenue
5% from each commission sale
May increase according to our stated growth plan
Monthly contributions from the founder
Optional contributions from community members
CDF funds may be used to:
Support creators with materials, tools, and equipment
Provide creative assistance or professional support
Offer studio access, development resources, or production help
Fund eco-community projects
Transparency: A public page may display the CDF balance and fund allocation history.
Legal Note: CDF contributions do NOT create ownership, equity, or financial rights for contributors. EcoCommunity retains all decision-making authority over fund distribution.
- Seed Packet Disclaimer
Every eligible order includes a free native seed packet. By accepting seeds, buyers agree:
To plant only where legally permitted
To follow local guidelines for native species
That germination and performance are not guaranteed
That EcoCommunity is not responsible for misuse or ecological impact
Seeds are provided “as-is” for ecological and educational purposes.
- Prohibited Items & Content
Sellers may NOT list or upload:
Illegal items or substances
Weapons or dangerous materials
Counterfeit or trademark-infringing goods
Hate-related, violent, or discriminatory content
Invasive plant species
Pornographic or explicit sexual content created solely for lust or erotic stimulation
NSFW Art Policy
EcoCommunity allows mature or adult-themed art only if it carries artistic, cultural, emotional, or narrative meaning. Pornographic materials, fetish content, or art created solely for sexual arousal are strictly prohibited.
EcoCommunity may remove any listing that violates these policies or does not align with community values.
- Shipping & Fulfillment
Sellers are solely responsible for:
Preparing, packaging, and shipping items
Meeting shipping timelines
Handling lost or damaged packages (unless otherwise stated)
EcoCommunity is not responsible for shipping issues.
- Returns, Refunds & Disputes
Buyers and sellers are responsible for handling refunds or disputes directly. EcoCommunity may assist at its discretion but is not required to provide refunds or financial compensation.
- Intellectual Property
Creators retain rights to their own work but grant EcoCommunity a non-exclusive, worldwide license to:
Display
Promote
Distribute
Feature their content on the Platform
This license ends when content is removed from the Platform.
- Termination of Accounts
EcoCommunity may suspend or terminate accounts that:
Violate these Terms
Harm the community
Commit fraud
Misuse the Platform
Sell prohibited items
Users may close their accounts at any time.
- Platform Availability
We may update, modify, suspend, or discontinue any part of the Platform. We are not liable for downtime, service issues, or technical errors.
- Limitation of Liability
EcoCommunity is not responsible for:
Losses resulting from transactions
Damages from use of the Platform
Lost profits, revenue, or data
Disputes between users
Shipping issues or product quality
You use the Platform at your own risk.
- Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes indicates acceptance.
